Hi Trez,
I know copyright law isn’t consistent from country to country that is why I asked the question and no I have no other intent re the photos.
They are as you say for my own use but I am just curious as to the copyright question. Thanks for the reply.
Your text is pretty illegible but that may be the result of scaling on the bevel and emboss.
Copyright laws are not consistent from country to country, but generally copyrights can be surprisingly long-lived. They can also be renewed, and that applies both to the book and to the photographs therein. Since what you are doing probably does not qualify as "fair use" and, most important, since the company that published them still exists, your safest course would be to enquire of them.
IANAL, but I have had to deal with a lot of copyright issues in printing, and I can assure you that it is best to know if you are on solid ground.
Of course, if you are doing this only for your personal use, no one is going to care–but my impression is that you have some other intent.
Hi John,
Thanks for the input.
This is the first time I have ever attempted to upload & access a photograph in a forum. The original size of the pic is 3508×4961 pixels, 25MB (flattened). The size on the host site is 640×905 pixels, 365KB.
I’m viewing it on a 17" notebook screen – 1440×900 and to me the text is clear and legible. Is there anything I can do to improve the quality?
As I said I think it’s the effect of scaling down for the web. It’s probably better at full size.
I see it like this:

However, the line spacing (leading) is too tight and, if legibility is your aim, you need to be more sparing with the effects.
Hi John,
I see what your saying but I think it must be the scaling down as it reads ok in print. Any thoughts on the copyright?
a lawyer’d be my guess. if it IS in public domain (whatever it is, 70 years or summat) you may not want to alert the publisher to apply for an extension. i’d check a lawyer if it’s really a concern.
but then, like trez said in post 1 (hey I read post #1 – usually! :)) if it’s JUST for personal use, it probably doesn’t matter.
If the company that published the book is still in existence, then I would contact them to see if they are re-publishing or renewed the copyright. I would contact the Scot gov web-site about copyright laws there.
McGoogle is your friend.
MacGoogle, Bart. Come on. 😀
It was undue American influence on my Canadian sensibilities that caused that 😉
Hi guys,
Thanks for the input.
‘a lawyer’, ‘publisher’ – I’m not paying for guys like that – that’s why I’m asking in this forum. I’m like Alice – just curious.
The photographs ARE for my own personal use. I did them (I think) in 1999/2000 when I was learning photoshop 4/5? and I had my brand new epson 1290S printer. I like experimenting and I saw the possibility to try something new with the pics.
You guys must have been in the same situation. Have you never looked at a really old (usually faded) photo and thought I could do something with that?
Regarding copyright. I have a book written in 1760. I doubt that it is still in copyright. Could I scan it and put it up on a website?
I have another book, written in 1846 with a lot of drawings of buildings. Could I scan them in and do my own thing with them?
Relax, I’m not going to, I’m just curious.
About the same time that I did the photographs I sent another one of a steam engine going over the Forth Bridge to a photography magazine asking the copyright question. THEY published the photo and underneath they replied similar to Trez’s post. It’s a grey area, careful what you do etc. Crazy. Why did they publish it?
I’m still non the wiser regarding copyright.
‘I’m still non the wiser regarding copyright.’ because you didn’t Google like I suggested, it’s free!
Hi Bart,
‘you didn’t Google like I suggested’
Aye, but you wrote Mcgoogle instead of Macgoogle!
Okay, I’ll dae it in a wee while.
I’ve goat tae go oot an’ buy somethin’ fur ma tea ye ken.
That was dave’s fault, he’s an American.
‘That was dave’s fault, he’s an American’
Aye but is he a Yankee or a gentleman of the South?
Willie,
Did you scale down with the text layer (and it’s layer style) intact? The that would explain the exaggerated bevel.
Here in the Netherlands copyrights expire 70 years after the creator’s death. So if someone would kill me, they’d still have to wait 70 years (in prison I hope) to fool around with my photos.

i’m a mets fan, from new jersey (transplanted in pennsylvania). not a yankee! 🙂
Hi Rob,
Thanks for the input.
What I did was resized the image down, flattened it, then saved for the web. After what John said in post #3 & #5, I got to thinking (I know, I’ll get a headache).
I think I’ve sussed it out. As I wrote previous, these image psd’s were created years ago. When I opened the castle image in Photoshop a dialogue box came up with something like ‘text needs to be updated’ and I clicked update. Presumably this slightly altered the spacing or whatever of the text. I will have to remember that if I ever print out another copy.
That’s what I like about this forum. There are so many hints & tips re photoshop. What I don’t like about the forum is I’ve got to try and remember them!
I’ll have to cross your name out of people I want to kill. I don’t fancy being in prison until I’m 135 years old.

start a text document and keep it on your desktop. update it when you come across a good tip. that’s what i do.
Hi Dave,
I’ve got a better idea – you start a text document and then when it’s full of tips you send it to me!
Seriously tho’ that’s another fine tip you’ve given me.

it’s a rich text file, i open it in wordpad.
Muchas gracias amigo!
23 pages of word text – I know what I’ll be reading in bed tonight! I hope it’s got a good ending.
I haven’t been keeping up with it recently, sorry.
Hi Dave,
Yes I’ve been in the FAQ several times before I came to the forum. Nobody would speak to me in there, that’s why I joined you lot.
I’ve never heard of the repository – is that no something medical? I suppos(itory)I’ll go there now.
