Trouble creating transparent EPS

I’m running photoshop 5 on a Windows 200o pro PC. I am having trouble saving images as eps files with transparent backgrounds. I used to get a dialogue box when I saved as an eps which would let me save as with a transparent background. Now this option doesn’t appear and all my new eps’s have a opaque white background. Leaving me Scoobied.
Any ideas boys (or girls)?
