Pattern Overlay in an Action

When creating a layer style with a pattern overlay in an action, the pattern overlay switches off and the pattern reverts to the first pattern in the pattern list. Sometimes the action runs properly immediately after it is made, but when Photoshop is restarted, the action fails.

Do pattern overlays not work through actions?

The computer is an amd 3000+ running windows xp pro with 1 GB ram. Photoshop is version 7.0.1.
