If you reopen the eps in Photoshop, what mode is it in? Are you sure you didn't somehow convert to CMYK?

Actually all I did was to put my picture in grayscale mode, then in duotone mode.
I chose 2 pantone colors and saved in EPS. I even tried to save in DCS (as it says
in Photoshop help) with no best result. Once in InDesign, it says my color is a spot one,
but the mode is CMYK.
Where are you seeing this CMYK mode? Are no Pantone swatches added? What happens if you select all unused and delete them?
